Student Agreement {{ X }} h/week
1. Appointment and Programme
1.1 This agreement confirms the appointment of Learning English Today Plus
(Hereafter referred to as “LET’) as the school, the academy, or the organisation to
{{ Full Name }}
(Hereafter referred to as” the student or participant” in the European Union) to carry out agreed EN/FR/ES/GE Tuition services, details of which are stated in accordance with the terms of this Agreement.
2. Commencement and Duration of the Agreement
2.1 This agreement will commence on {{ date }} and for a period of {{ X }} month(s) (x weeks), and it will renew itself automatically every month unless terminated sooner under the provision of clause 8 of the Agreement. After this period, it will continue in effect until terminated under the provision of clause 8.
2.2 This agreement duly signed, and after payment is received, the Student account will be credited to {{ hours }}h/ week in form of (55mins) class to learn EN/FR/ES/GE language for the period mentioned in clause 2.1.
3. LET’s Obligations
LET agrees with the Student during the term of this Agreement:
a) at all times to provide, protect and foresee the interests of the Student.
b) at all times to supply a high quality and reliable service to the Student.
c) in all matters to act professionally and loyally to the program provided to the Student.
d) to participate fully to the evolvement of the Student through providing proper education.
e) to elaborate, design and distribute quality materials in advance to the Student to follow up classes (available on our website through the individual Student account).
f) to provide a level assessment for every single new Student to the LET standard in the form of 30 mins free trial (for private tuition) and a level assessment of 10/15 mins (for group classes).
g) to provide Students with a Google drive access through the LET website to easily access every class content, (after and during class).
h) in any case, when this agreement is duly signed and the course fully paid, there will be no refund possible in any circumstances.
i) rescheduling classes free of charge will be tolerated to a maximum of {{ hours }} class per calendar month totalling a maximum of {{ hours X months }} class for the period of this agreement.
j) rescheduling will need to be made anytime the Student wishes up to 24 hours before the beginning of the class and according to the commitment duly signed in this agreement.
k) in any case, if rescheduling slots were not taken within the specific month, the total number of possible rescheduling classes will not be affected, therefore a maximum of {{ hours X months }} class would remain possible during the period of this agreement only.
l) in any case, LET will provide possibilities in rescheduling classes after the total number of slots agreed have run out for a fee of 5€ per class to be rescheduled.
m) in any case, if the assigned teacher cannot provide the service due to internal reasons or unforeseen circumstances, LET will try to provide a covering teacher whenever possible.
n) in any case, LET will deal fairly and/or equally to every Student in respect to this agreement.
4. The Student’s Obligations
4.1 The Student agrees with LET during the term of this Agreement:
a) to provide the right information and documentation requested by LET to complete enrolling the Student to the programme.
b) to offer a minimum of 3 options in form of days and time for tuition.
c) to accept having a level assessment before any class booking.
d) not to miss pre-arranged slots of booked classes without any reasonable excuse unless it is considered as unforeseen circumstances (evidence of such unforeseen circumstances event could be asked).
e) to notify LET of attendance cancellation at least 24 hours in advance of a scheduled class; if not, the payment for that slot will be lost and not refundable.
f) to enter the classroom on time or not later than 15 mins after the class begins. If not, access will then be denied by the teacher and the class counted as taken, payment lost, and the class will not be rescheduled nor refunded.
g) in any case, if the Student arrives late for the class, but not later than 15 mins after the start of the scheduled class, the class itself will not run beyond the scheduled end time in any circumstances, therefore the maximum time left in such event will be 40 mins of tuition.
h) to follow Teachers' instructions during tuition relating to the tasks required and to the best of the Students' abilities.
i) to work in a mutual and reciprocal environment respecting any other fellow participants; and
j) to encourage, include and allow other Students to participate equally to the class.
k) to log in into the Student’s account through LET’s website to access the class link and any materials and contents necessary to follow the scheduled tuition.
l) in any case, the Student agrees to have a replacement teacher in such case mentioned in clause 3.1.m.
m) to be responsible for their own classroom setup with the following:
- having a reliable device such as computer, laptop, or a tablet to allow him/her to follow classes in a good environment (a minimum requirement). Telephone could be accepted as an emergency device but cannot be used on regular basis. A device should have a good quality camera and microphone.
- having a reliable internet connection.
- having a quiet environment.
n) in any case, if the classroom requirements set out in clause 4.1.m are not respected the Student accepts that the teacher may deny entry to the class.
5. Approval by the Student
5.1 The expression “Written Approval” in this agreement shall mean written approval by the Student.
5.2 The Student should notify LET in writing of any change occurring during the term of the Agreement.
5.3 LET shall not be responsible for any delay or cancellation in the performance of the service resulting from the unavailability of external factors such as Internet performance in either the Student or teachers ends, and/or faulty videoconference operating systems.
6. Fees Payable
6.1 The administration service fee, exclusive of VAT, and based on database management and administrative time in the EU, will be charged at the flat rate in one single payment of €25.
6.2 The operating service fee, exclusive of VAT, is € X per hour (55 mins) based on 1 hour slot of language learning session with a native, qualified, and experienced teacher, subcontracted by LET, for the purpose of teaching EN/FR/ES/GE as a Foreign Language. The fee according to the above service is {{ fee }} for Monthly Payment - No commitment / Package 1 – 3-month commitment / Package 2 – 6-month commitment / Package 3 – 12-month commitment (x weeks) {{ hours }}h/ week purchased through the LET website.
7. Payment Terms
7.1 The administration service fee of €25 will be invoiced via the LET website or by email and should be paid in full in advance of the registration.
7.2 The first operating service fee of a minimum of {{ total hours }} full classes will be invoiced via email and/or through LET's website and paid in advance of the registration and at the same time as the administration service fee.
7.3 This written approval must be signed, and the minimum payment must be paid in full by the participant to allow the program to start.
8. Termination
8.1 This Agreement may be terminated by the Student at any time after the initial period of three months (and if such event occurs in plans over 3 months, no refund will be available).
8.2 If payments are not made by the Student in accordance with clause 6.2 of this Agreement, the Student will not have access to the classroom until such payments are made. If the Student does not remedy the breach within 14 days of written notice, LET will have the right to terminate the Agreement immediately by notice in writing to that effect.
8.3 This Agreement may be terminated by LET at any time without notice if the participant is in breach with clause 4.1 d-e-f.
8.4 Either party may terminate the Agreement immediately upon writing notice to the other in the event of:
a) any material breach of the Agreement by either party, which breach is not remedied
(if capable of remedy within the time frame allocated in clause 8.2).
b) any unforeseen circumstances that make either party insolvent.
9. Legally
9.1 This agreement can only be argued and/or challenged under the UK Law & Regulations.
9.2 This agreement is exclusive to the above nominee only, whose mission has been drawn and established on this document above. The services previously agreed with the Student can only be provided to him/her, for his/her own benefit, otherwise legal action could be undertaken under the UK Law & Regulations.
10. Data Protection Act 2018
a) Our commitment to you
LET is committed to protecting your privacy and ensuring that your details and personal information as required by our administration is completely secured. Once the information is in our system, it is accessible to authorised LET member of staff only. We strictly enforce our privacy policies with our employees and any breach of this policy will result in immediate termination of the “Agreement” as signed with them. LET will not share any of your private data or information with any organisations.
b) How we use your Personal Information
Your personal information will be used solely in the provision of the requested products and services. This includes the use of information for completing transactions or communicating back to you. Credit card numbers, IBAN or PayPal information are used only for payment processing and are not used for any other purpose.
